GENERAL CONTRACTING CONDITIONS

This agreement regulates the general conditions of purchase of the various products and services offered on this website by AZETA BILLIARDS, belonging to Azeta Billiards, SL with CIF .: 67502369, fiscal address at Nàpols 217, 3-1 08013 Barcelona, ​​SPAIN.

The CUSTOMER at the time he completes the registration process, and purchases any of our products, expressly accepts and submits to the clauses specified below, as well as the conditions of access and use of our portal and its privacy policy, accessible through the link “Legal Notices”.

The CUSTOMER acknowledges having sufficient legal capacity to contractually bind himself.

This contract is permanently accessible in the legal notices on our website, and can be downloaded in PDF format at the time of contracting.

  1. Prices, transportation costs and taxes

In consideration for the purchased product, the CUSTOMER agrees to pay AZETABILLIARDS expressly the amounts specified at the time of purchase in the price list established on the website www.azetabilliards.com for the chosen products.

The prices detailed for each product include the corresponding Value Added Tax (VAT).

Transport costs for Spain are included in the price of the products, with the exception of Ceuta, Melilla, the Canary Islands and Europe.

The billiard tables and their accessories do not have the freight included either.

Once the selection of products is completed and prior to the confirmation of the order and before proceeding to pay for it, the final purchase price will appear on the screen, including transport costs and the corresponding VAT.

Anything that is not specified in the description as included is not included.

  1. Purchase procedure

Through this website, orders can only be made by individuals over the age of 18 and companies.

On the website all our products are detailed individually. The procedure for making and managing the purchase is indicated on the website and only the following steps should be followed:

  1. Choose the product you want to purchase.
  2. By selecting a product, it can be added to the Shopping Cart and you can choose to continue buying or process the order.
  3. To process the order, if it is the first time that you access our portal, you must complete a registration form with your personal data and create a personal account as a user. After completing this step, you will receive, in the email you have indicated, confirmation that the registration has been completed correctly. In case you are a registered user, to continue with the purchase process it will be enough to enter the username and password that you generated in the first purchase. The user code and password are personal and correspond to the person who carried out the registration process, who is solely responsible for its custody. Through your account you can manage the information we have and modify or update your data.
  4. In the registration process it will be necessary to indicate the billing and delivery addresses of the purchase made. It will be possible to indicate a unique address for billing and delivery.
  5. Next, the order will be verified, where the selected items are detailed one by one and the total price is calculated.
  6. Once the process has been processed, it will be necessary to previously mark a check box for reading and accepting these terms and conditions of sale.
  7. On the website you will be provided with the mechanisms so that payment can be made depending on the system chosen in each case.
  8. Once you have entered the data for payment, you must confirm the order by pressing the “Buy” button.
  9. Once the “Buy” button is pressed, the product will be delivered.

The CUSTOMER acknowledges that the photographs and descriptions of the products on the website are an approximate image of the products and services offered, so it is possible that they may differ from the original. The descriptions and illustrations of the products offered through this website are made for information purposes only.

  1. Availability and Delivery

The products offered by AZETABILLIARDS are available for distribution in mainland Spain and the Balearic Islands and in the European Union.

Orders will be processed once payment has been successfully received.

The products offered by AZETABILLIARDS will always be subject to availability, which will be specifically indicated on our website (There is product that can be reserved) for each product, so if any article offered without the possibility of ordering it is not available, it will be specifically indicated in our Web (Out of Stock). In case of being a product without stock but that can be ordered with a minimum delivery time of 15 days, it will be specifically indicated on our website (Available for reservation).

Pool tables due to different wood finishes will not always be available. In stock are the standard models, if you want a custom table, in sizes and finishes, these will be available for reservation, to take into account that the factory delivery time is 4 months. The table freight is not included, in case of making the purchase from the web, Azetabilliards will contact the customer to calculate the freight. It is advisable to contact directly to info@azetabilliards.com to find out in more detail the different possibilities of personalization of the table that the Diamond Billiards offers you.

Under normal conditions, all the products that appear on our website are available for delivery within the indicated time frames.

Once the order has been placed, if the product contracted by the CLIENT is out of stock, they will be promptly informed of it, and will be offered an alternative product with similar characteristics of the same price and quality as purchased, but if the CUSTOMER is not interested in accepting the proposed alternative, AZETABILLIARDS will proceed to refund the amount already paid and inform him of the procedures and deadlines for reimbursement.

As a general rule, local delivery will be between 3 and 5 business days from the time of purchase and from the moment we have confirmed your payment. These delivery times are approximate and in no case guaranteed by AZETABILLIARDS, except in the cases of unavailability described, will deliver within a maximum period of 30 days.

Deliveries will be made on working days (Monday to Friday). It is recommended that the CUSTOMER communicate his time preferences for delivery when completing the order data in the section for Comments.

The product delivery will arrive to the customer with a receipt of purchase,that the customer must sign. 

The customer  will be informed in the event that a shipment is delayed.

If delivery to the indicated address is not possible due to the absence of the recipient, the carrier will contact the CUSTOMER directly, and steps to be followed will be detailed. In the event that the impossibility of delivery is caused by having entered a wrong address, the cost of re-dispatching the order must be covered by the CUSTOMER. 

AZETABILLIARDS is not responsible for delays in the delivery caused by either the customer or the carrier.

In order to keep you informed of the management of your purchase, you will receive by email a notice confirming your order and payment.

However , the CUSTOMER can check the status of his order by sending an email to the email info@azetabilliards.com.

  1. Payment options and time frames

The following forms of payment are accepted:

  • PayPal: The transaction is carried out by connecting directly to the PayPal payment gateway, through the client’s own account, a totally secure method.
  • Bank debit / credit card, Visa and Mastecard are accepted, through the payment gateway offered by the SERVIRED system.
  • Bank transfer or deposit directly from an office of my  financial institution Banco Santander, to the account number ES4400493997612414001811

Once the payment has been made, you will receive a confirmation email.

All our payment systems are totally safe.

Payments must be made before procedding to ship your product. 

AZETABILLIARDS will not provide the requested product until payment has been processed in full. 

AZETABILLIARDS reserves the right to temporarily or permanently cancel deliveries, in the event of any incident regarding collection.

  1. Invoices

When making the corresponding payment, you will receive the Invoice of your purchase in PDF format in the email you have indicated for this purpose at the time of processing the order.

The CUSTOMER must confirm product notification reception as well as letting us know of any changes about his information, AZETABILLIARDS being exonerated from any responsibility derived from this circumstance.

  1. Warranty

All our products are subject to quality controls and are guaranteed against production defects depending on the product. Pool tables have a 1 year warranty, from the date of purchase. The rest of the products and materials have a 3-month warranty. The warranty covers any manufacturing, design or material defects, although it will be necessary to reveal the lack of conformity within 14 days from when it became aware of it. The warranty covers only defective products. It does not cover blows, improper use, or others that are not attributable to a supplier defect or a defect in the product. During the warranty period the CUSTOMER may return the product and we will proceed to its repair or replacement. The transport costs generated by the returns under warranty will NOT be paid by the CUSTOMER.

The warranty document is the purchase invoice.

  1. Returns

In the event of a factory defect or errors in the delivered product, returns or exchanges of parts will only be accepted if they have not elapsed more than 14 days from receipt, if they include the packaging and accessories and it is verified that they are a manufacturing or packaging defect or anomaly and not improper or negligent use, handling or storage. They will always be accompanied by the corresponding delivery note or invoice.

Both in the case of a return due to a manufacturing or packaging defect and in the case of an error in the order, the customer will be offered, if possible, the repair of the part or its replacement by another alternative at no additional cost and without right, of the CUSTOMER, to any type of compensation. The costs generated by shipping the repaired or correct order will be covered by AZETABILLIARDS.

In any case, the return will always be subject to prior examination by AZETABILLIARDS of the condition of the product being returned and to the verification that the requirements of these conditions of sale have been met. Once the return is received and if applicable, we will refund the amount collected within a maximum period of 14 days and in the same terms that were used to make the payment.

AZETABILLIARDS reserves the right to reject returns reported or sent after the deadline or for products that are not in the same conditions in which they were received.

Returns will be managed by sending an email to info@azetabilliards.com with a description of the reasons and the alleged causes for the return. Likewise, it will be necessary to indicate the name and surname and the reference number of the order. Once the request is received, we will process it in a timely manner.

  1. Right of withdrawal

You have the right to withdraw from this contract within 14 calendar days without justification.

The withdrawal period will expire 14 calendar days from the day that you or a third party indicated by you, other than the carrier, acquired material possession of the goods.

To exercise the right of withdrawal, you must notify us by email: info@azetabilliards.com, your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax or email). You can use the model withdrawal form below, although its use is not mandatory.

To meet the withdrawal period, it is sufficient that the communication regarding the exercise by you of this right is sent before the corresponding period expires.

Consequences of withdrawal:

In the event of withdrawal, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a different delivery method than the  less expensive ordinary system that we offer) and with the exception of pool tables and their accessories, which do not include delivery costs, therefore, will not be returned. The withdrawal must be made without any undue delay and, in any case, no later than 14 calendar days from the date on which you inform us of your decision to withdraw from this contract. We will proceed to make said refund using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; in any case, you will not incur any expenses as a result of the refund.

We may retain the refund until we have received the goods, or until you have presented proof of the return thereof, depending on which condition is met first.

You must return or deliver the goods directly to AZETABILLIARDS c / Nàpols, 217 3-1 08013 Barcelona (SPAIN), without any undue delay and, in any case, no later than 14 calendar days from the date on that you communicate your decision to withdraw from the contract. The deadline will be considered fulfilled if you return the goods before the deadline has expired. In the case of a pool table or table accessory, you must previously notify us at the email info@azetabilliards.com, of the exact date of departure, as well as the transport company, so that we can provide you with a valid address for receiving This table or table accessory, also if the table has already been assembled by the installer according to the express order of the client, the latter must hire the same installer again to proceed to disassemble it, thus ensuring that it is not damaged in any way.

You will only be responsible for the decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and operation of the goods.

  1. Perfection of the contract and modifications of the services

This contract will be perfected with the payment of the product and the sending to the CUSTOMER of a confirmation email with a description of the purchase made.

AZETABILLIARDS reserves the right to modify in any way the characteristics and conditions of its services, always with the aim of improving them and that is of benefit to the CUSTOMER.

  1. Parties obligations

AZETABILLIARDS undertakes to provide the CUSTOMER  with the products and services that have been contracted applying the utmost diligence in the provision of the service, as well as to take care of the maintenance of the facilities necessary for the operation of the network, having for it an adequate technical and computer team, and to manage the logistics, shipping and delivery operations of the purchase made through the carrier.

The CUSTOMER agrees to use the services made available to them in good faith, without violating the laws in force in any matter or infringing the rights of third parties, as well as paying the selected product in the time and manner set out in these conditions. of sale and to its reception in the indicated place for the delivery.

  1. Communications

All notifications between the parties will be made preferably via email. The CUSTOMER is responsible for confirming the receipt of the notifications and informing AZETABILLIARDS of any changes to their data, and the latter is exempt from any liability arising from this circumstance. In case of modification, the CUSTOMER must inform AZETABILLIARDS by updating their data on our website.

In compliance with article 21 of Law 34/2002 on Services of the Information Society and Electronic Commerce, we inform you that our commercial shipments and information regarding our website and the products offered therein, will be made by email to the e-mail address you provide us, always on a revocable basis. In any case, you have the option to reject our commercial communications by sending an email to the address info@azetabilliards.com indicating in the subject the word LOW.

  1. Commitment, acceptance and validity of the contract

The CUSTOMER acknowledges having read and accepted the legal conditions of use and the privacy policy of the website.

The CUSTOMER acknowledges that he has understood all the information regarding the products and services, including type of delivery provided, as well as all the conditions and stipulations contained in this electronic contract, for which he affirms that they are sufficient for the exclusion of the error in the consent of this contract, and therefore, it accepts them fully and expressly.

The CUSTOMER is fully aware that the acceptance and execution of this contract will take place by supplying their data and pressing the “Buy” button indicated on our website and that it will be perfected with the payment of the service.

  1. Applicable Regulations

This contract is commercial, and will be governed and interpreted in accordance with Spanish law.

In the event of any type of discrepancy or difference between the parties in relation to the interpretation, content or execution of the Contract that is not resolved by mutual agreement, the Parties will submit to the courts or tribunals that are competent in each case .

  1. Personal data

In compliance with the Organic Law 15/1999 on the Protection of Personal Data, we inform you that the personal data you provide us to carry out the contracting process and those derived from the provision of the service, are confidential and will be incorporated into a file of “Management” responsibility of AZETABILLIARDS, in order to provide you with the purchased items, as well as send you commercial information about our items and products, including by email.

Likewise, we inform you that the personal data provided is treated internally and with the utmost confidentiality, applying the security measures regulated in Royal Decree 1720/2007 and that they are not published or transmitted to third parties to be used for commercial or promotional purposes.

At any time oppose the receipt of our commercial shipments, as well as exercise the rights of access, rectification, cancellation and opposition in the terms legally established before AZETABILLIARDS – info@azetabilliards.com

In general, it is absolutely prohibited to provide personal data of the children under 14 without the consent of parents or legal guardians.
